Welcome to F4NS. These Terms of Service (“Terms”) govern your access to and use of the F4NS platform, website, and services (collectively, the “Service”) operated by F4NS Ltd (“F4NS,” “we,” “our,” or “us”). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Please read these Terms carefully. They contain important information about your legal rights, remedies, and obligations, including limitations on our liability, a disclaimer of warranties, and a binding arbitration clause.

1. Acceptance of Terms

By creating an account, accessing, or using the F4NS Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, Cookie Policy, and any other policies or guidelines incorporated herein by reference.

These Terms constitute a legally binding agreement between you and F4NS. We reserve the right to modify these Terms at any time. When we make changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you via email or a prominent notice on the Service. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms.

2. Eligibility

The F4NS Service is intended solely for individuals who are 18 years of age or older. By accessing or using the Service, you represent and warrant that:

• You are at least 18 years of age;
• You have the legal capacity to enter into a binding contract;
• You are not prohibited by law from accessing or using the Service in your jurisdiction;
• You are not a person barred from receiving services under the laws of the United Kingdom, the United States, or any other applicable jurisdiction;
• You have not been previously suspended or removed from the Service by F4NS.

We take the protection of minors extremely seriously. If we discover or have reason to believe that any user is under 18 years of age, we will immediately terminate that user's account and remove any associated content. If you become aware of any user who may be underage, please report it immediately to legal@f4ns.com.

3. Account Registration and Security

To access certain features of the Service, you must register for an account. When registering, you agree to provide accurate, current, and complete information and to update such information as necessary to keep it accurate, current, and complete.

You are responsible for:

• Maintaining the confidentiality of your account credentials, including your password;
• All activities that occur under your account, whether or not authorised by you;
• Notifying F4NS immediately of any unauthorised use of your account or any other security breach at security@f4ns.com;
• Ensuring that you log out of your account at the end of each session, particularly when using shared or public devices.

F4NS will not be liable for any loss or damage arising from your failure to comply with these security obligations. You may not create more than one personal account, and you may not transfer your account to any other person or entity without our prior written consent.

4. AI-Generated Content

F4NS is an AI creator platform. All creator personas, profiles, images, videos, text, audio, and other content on the platform (“Content”) are entirely AI-generated. You expressly acknowledge and agree that:

• No Content on F4NS depicts, represents, or involves real, identifiable human beings unless explicitly stated otherwise in connection with operator-managed accounts;
• All creator personas are fictional constructs generated by artificial intelligence systems;
• Any resemblance to real persons, living or deceased, is entirely coincidental;
• Interactions with creator personas, including messages, are facilitated by AI systems and do not constitute communications with real human individuals;
• F4NS makes no representations that any AI-generated persona constitutes or simulates a real person, and you agree not to interpret or rely upon any Content as representing a real individual.

All AI-generated Content on F4NS is produced by or under the direction of licensed platform operators (“Creators”). Creators retain ownership of and responsibility for the Content they generate and publish through their operator accounts, subject to the licence granted to F4NS in these Terms.

By using the Service, you grant F4NS a non-exclusive, worldwide, royalty-free licence to host, display, and distribute Content you upload or generate via the Service, solely for the purposes of operating the platform and providing the Service to you.

5. Subscriptions, Payments, and Refunds

5.1 Subscription Plans

F4NS offers subscription-based access to creator content. Subscription fees, billing cycles, and included features are described on the relevant creator's profile page and at the point of purchase. By subscribing, you authorise F4NS to charge your payment method on a recurring basis until you cancel.

5.2 Pay-Per-View and Tips

In addition to subscriptions, certain Content may be available for individual purchase (“Pay-Per-View”), and users may send monetary tips to creators. All such transactions are final at the time of purchase.

5.3 Revenue Split

F4NS operates on an 80/20 revenue-sharing model. Creators (platform operators) receive 80% of all subscription revenue, Pay-Per-View sales, and tips generated through their accounts, net of payment processing fees. F4NS retains 20% as a platform service fee. Detailed earnings statements are available within the Creator Studio.

5.4 Billing and Payment

All prices are displayed in the currency applicable to your region. Payment is processed by our authorised third-party payment processors. You agree to pay all fees associated with your account and to provide accurate and complete billing information. F4NS reserves the right to modify pricing with reasonable advance notice.

5.5 Cancellations and Refunds

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period; you will retain access to subscribed content until that date. Subscription fees are generally non-refundable except where required by applicable law. If you believe you have been charged in error, please contact support@f4ns.com within 14 days of the charge.

5.6 Chargebacks

Initiating a chargeback or payment dispute for a valid charge without first contacting F4NS support may result in suspension or permanent termination of your account. F4NS reserves the right to dispute any chargeback that we believe to be fraudulent or unwarranted.

6. Prohibited Conduct

When using the F4NS Service, you agree not to:

• Use the Service if you are under 18 years of age or are not legally permitted to access adult content in your jurisdiction;
• Attempt to access, tamper with, or use non-public areas of the Service, F4NS's computer systems, or the technical delivery systems of F4NS's providers;
• Probe, scan, or test the vulnerability of any system or network, or breach or circumvent any security or authentication measures;
• Scrape, crawl, or spider any part of the Service without our prior written consent;
• Attempt to reverse-engineer, decompile, or disassemble any software or systems used to deliver the Service;
• Use automated tools, bots, or scripts to interact with the Service in a manner that imposes an unreasonable load on our infrastructure;
• Engage in any conduct that impersonates another person or entity, or misrepresents your affiliation with any person or entity;
• Harass, abuse, threaten, or intimidate other users or F4NS staff;
• Transmit any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable;
• Attempt to purchase, sell, or transfer your account to another party;
• Use the Service to distribute spam or unsolicited commercial communications;
• Violate any applicable local, national, or international law or regulation;
• Circumvent, disable, or otherwise interfere with security-related features of the Service;
• Collect or harvest personal information of other users without their express consent.

Violation of any of the above may result in immediate suspension or termination of your account, without refund, and may subject you to civil or criminal liability.

7. Intellectual Property

The F4NS Service, including its design, software, trademarks, logos, and all platform-originated Content, is owned by F4NS Ltd or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial use.

You may not reproduce, distribute, publicly display, publicly perform, create derivative works of, or otherwise exploit any Content or materials from the Service without F4NS's express prior written permission, except as permitted by applicable law.

Creator operators retain ownership of original Content they produce and upload to the platform. By publishing Content on F4NS, creators grant F4NS a worldwide, royalty-free, sublicensable licence to host, store, transcode, display, and distribute that Content in connection with operating and promoting the Service.

The “F4NS” name and logo are trademarks of F4NS Ltd. You may not use these marks without our prior written consent.

8. Content Removal and DMCA

F4NS respects intellectual property rights and expects users and operators to do the same. We respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) and applicable law. Please see our DMCA Policy for full details on how to submit a takedown notice, the counter-notification process, and our repeat-infringer policy.

F4NS also reserves the right to remove any Content at any time, without notice, that we determine in our sole discretion to be in violation of these Terms, applicable law, or otherwise harmful to the Service, our users, or third parties.

9. Disclaimers and Limitation of Liability

9.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. F4NS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, F4NS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL F4NS'S AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO F4NS IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED POUNDS STERLING (£100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

10. Termination

You may terminate your account at any time by navigating to your account settings and selecting “Delete Account,” or by contacting us at support@f4ns.com. Termination of your account will result in the deactivation and deletion of your account and your access to the Service.

F4NS reserves the right to suspend or terminate your account, with or without notice, at any time and for any reason, including but not limited to breach of these Terms, suspected fraud, illegal activity, extended inactivity, or where required by law. Upon termination, all licences granted to you under these Terms will immediately cease.

Termination of your account does not entitle you to any refund of amounts paid, except as required by applicable law. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any dispute arising from or in connection with these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer resident in another jurisdiction where mandatory consumer protection laws provide you additional rights.

Before initiating any formal dispute proceedings, you agree to first contact F4NS at legal@f4ns.com and provide a written description of the dispute, and allow F4NS 30 days to attempt to resolve the matter informally.

If you are an EU or UK consumer, you may also be entitled to use alternative dispute resolution (ADR) schemes. For UK users, information about ADR is available from the Citizens Advice Bureau. For EU users, the European Commission provides an online dispute resolution (ODR) platform at ec.europa.eu/consumers/odr.

12. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy, Cookie Policy, and any other incorporated policies, constitute the entire agreement between you and F4NS with respect to the Service and supersede all prior agreements and understandings.

Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver. F4NS's failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.

Assignment. You may not assign or transfer your rights or obligations under these Terms without F4NS's prior written consent. F4NS may assign these Terms without restriction.
