DMCA Takedown Policy

F4NS Ltd (“F4NS,” “we,” “our,” or “us”) respects the intellectual property rights of others and expects all users, creators, and operators on the F4NS platform to do the same. This DMCA Takedown Policy describes how F4NS responds to notices of alleged copyright infringement in compliance with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512, and applicable international copyright laws.

F4NS is an AI creator platform. While the majority of content on the platform is AI-generated, this policy applies to all content hosted on or transmitted through the Service, including AI-generated content, user-uploaded materials, and any other works that may be subject to copyright protection.

1. Designated Copyright Agent

2. Filing a DMCA Takedown Notice

If you believe that content hosted on F4NS infringes your copyright, you may submit a written takedown notice to our Copyright Agent. Under the DMCA, your notice must include the following information:

  • A physical or electronic signature of the copyright owner or a person authorised to act on their behalf;
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works;
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit F4NS to locate the material (including specific URLs);
  • Information reasonably sufficient to permit F4NS to contact the complaining party, such as an address, telephone number, and, if available, an email address;
  • A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law;
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and legal fees incurred by the alleged infringer or by F4NS.

3. AI-Generated Content Considerations

F4NS is an AI-exclusive creator platform. The copyright landscape surrounding AI-generated content is evolving. We recognise the following principles in handling DMCA matters related to AI-generated works:

  • Likeness and style claims: If AI-generated content on F4NS reproduces your copyrighted work or creates a substantially similar derivative, you may file a takedown notice under this policy.
  • Model training output: If you believe AI-generated content on F4NS was produced using a model trained on your copyrighted material in a manner that constitutes infringement, we encourage you to contact us with specifics so we can investigate.
  • Persona and brand confusion: If an AI persona on F4NS is designed to impersonate or create confusion with your brand, trademark, or public identity, please contact us directly at legal@f4ns.com so we can address the matter under our broader intellectual property policies.

We take these matters seriously and will evaluate each claim on its merits, applying current legal standards and guidance from relevant authorities.

4. How F4NS Processes Takedown Notices

Upon receiving a valid DMCA takedown notice, F4NS will take the following steps:

  • Promptly remove or disable access to the allegedly infringing material;
  • Notify the user or creator who posted the material that it has been removed or disabled, and provide them with a copy of the takedown notice;
  • Inform the affected party of their right to submit a counter-notification;
  • Document the notice and all actions taken for our records.

We aim to process all valid takedown notices within 2 business days of receipt. In cases involving potentially harmful or clearly infringing content, we may act more expeditiously.

5. Counter-Notification

If you believe that material you posted on F4NS was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification to our Copyright Agent. Your counter-notification must include:

  • Your physical or electronic signature;
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled (including the URL);
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal courts located in England and Wales (or, if you are outside the UK, that you consent to jurisdiction in any judicial district in which F4NS may be found), and that you will accept service of process from the person who provided the original takedown notification or an agent of such person.

Upon receiving a valid counter-notification, F4NS will promptly forward a copy to the party who filed the original takedown notice. If the original complainant does not file a court action seeking a restraining order against the alleged infringer within 10 business days of receiving the counter-notification, F4NS will restore the removed material within 10 to 14 business days after receipt of the counter-notification.

6. Repeat Infringer Policy

F4NS has adopted and implements a policy for the termination, in appropriate circumstances, of users and creators who are repeat infringers of copyright. Our policy operates as follows:

  • First offence: The infringing material is removed and the user receives a formal warning via email detailing the infringement and our policies.
  • Second offence: The infringing material is removed, the user receives a second and final warning, and their ability to upload new content may be temporarily suspended for up to 30 days.
  • Third offence: The user's account is permanently terminated. All content associated with the account may be removed from the platform.

F4NS reserves the right to terminate any account at any time if, in our sole discretion, we determine that the user has engaged in egregious or wilful infringement, regardless of the number of prior notices. Counter-notifications that successfully result in the restoration of material will not be counted as strikes under this policy.

7. User-Uploaded Content

While F4NS is primarily an AI-generated content platform, users and creators may upload certain supporting materials such as profile images, banners, or promotional assets. By uploading any content to F4NS, you represent and warrant that:

  • You own or have the necessary licences, rights, consents, and permissions to use and authorise F4NS to use the content;
  • The content does not infringe upon the copyrights, trademarks, rights of privacy, rights of publicity, or other intellectual property or proprietary rights of any person or entity;
  • You will indemnify F4NS against all claims arising from the content you upload.

Any user-uploaded content found to infringe third-party rights will be removed promptly, and the uploading user's account may be subject to action under our Repeat Infringer Policy.

8. Good Faith and Misrepresentation

F4NS takes the integrity of the DMCA process seriously. We expect all parties to act in good faith when submitting takedown notices and counter-notifications.

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages. This includes legal fees and costs. F4NS reserves the right to seek damages from any party that abuses the DMCA process, including the filing of fraudulent or bad-faith takedown notices.

9. Modifications to This Policy

F4NS reserves the right to modify this DMCA Takedown Policy at any time. Changes will be effective upon posting the revised policy on this page with an updated “Last updated” date. We encourage you to review this page periodically for any changes. Your continued use of the Service after any modifications constitutes your acceptance of the revised policy.
